Terms & Conditions

These Terms & Conditions govern all project-based design and branding services provided by Eli Weissman LLC (“Service Provider,” “I,” “me”) to the client (“Client,” “you”).

By submitting payment, the Client agrees to the following terms:

1. Scope of Work
Each project is defined by an agreed-upon scope, deliverables, and fee (per the Pricing Plan or a custom proposal). Work will only begin once the initial payment is received.

2. What’s Not Included
Unless explicitly agreed upon in writing, the following are not included in any project:

  • Web development (coding, implementation, hosting, domain, maintenance)

  • Printing or production services

  • Photography or videography

  • Product sourcing

  • 3D renderings

  • Legal services (e.g., trademarking)

  • Media buying or ad placement

For Figma sites, my services cover design only. I can recommend third-party developers, but they will contract, communicate, and bill directly with the Client.

3. Workflow & Revisions

  • Projects are managed one at a time, based on agreed scope.

  • Reasonable revisions are included until approval.

  • Once a deliverable is approved and closed, any new changes are treated as a new project.

  • If revision requests become excessive or unreasonable, I reserve the right to adjust scope, pause work, or terminate the agreement.


4. Proofing & Approvals
The Client is responsible for reviewing and approving all deliverables before use. Eli Weissman LLC is not liable for errors or omissions approved by the Client.

5. Ownership & Usage Rights

  • Upon full payment, the Client owns the final, approved deliverables.

  • All unused concepts, drafts, or design explorations remain the intellectual property of Eli Weissman LLC.

  • Working files (native design files, layered assets, etc.) are not included unless explicitly agreed in writing.

  • I retain the right to:

    • Showcase final work in my portfolio.

    • Reference the Client’s brand in client lists.

    • Submit work for awards, publications, and promotional use.


6. File Delivery & Retention

  • Final deliverables will be shared digitally upon completion and final payment.

  • The Client is responsible for downloading and storing deliverables. Long-term file storage by Eli Weissman LLC is not guaranteed.


7. Payment Terms

  • A 50% non-refundable deposit is required before work begins.

  • The remaining 50% balance is due before final deliverables are released.

  • Payments are non-refundable once work has commenced.

  • Late or missed payments may result in paused or terminated work.


8. Fees & Expenses

  • Credit card payments may incur a processing fee of 3–5%.

  • Any third-party costs (printing, shipping, domains, hosting, stock assets, developers, etc.) are billed directly to the Client.


9. Timelines

  • Standard project timelines will be outlined in proposals or agreements.

  • Timelines may shift if Client feedback, approvals, or assets are delayed.


10. Point of Contact
The Client must appoint a single authorized individual for communication, approvals, and feedback.

11. Termination Clause
Eli Weissman LLC reserves the right to terminate a project if:

  • Revision requests are excessive or abusive.

  • Demands go beyond agreed scope.

  • Communication is unreasonably delayed or uncooperative.

  • Payments are missed or late.

In such cases, deposits and payments made are retained, and no refunds will be issued.

12. Confidentiality
Both parties agree to keep all proprietary business information, materials, and communications confidential during and after the project.
 
13. Legal
This agreement is governed by the laws of the State of New Jersey.
 By submitting payment, you acknowledge and accept these Terms & Conditions in full.
